1. Agreement to Terms

By accessing or using PerchLens ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is operated by PerchLens ("we", "us", "our").

2. Description of Service

PerchLens provides web analytics software that allows you to track visitor activity on your websites. The Service includes a tracking script, a dashboard for viewing analytics data, and related APIs.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account and all activity that occurs under it. You must provide accurate and complete information when creating your account.

4. Free and Paid Plans

The Service offers a free plan with limited features and a paid Pro plan. Free plan users are limited to 1 website and 10,000 pageviews per month. Pro plan features and pricing are described on our pricing page. Payments are processed by Paddle, our merchant of record. Refunds are handled according to our Refund Policy.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Transmit malicious code or interfere with the Service
• Use the Service to track users without appropriate legal basis
• Resell or redistribute the Service without permission

6. Data and Privacy

Our tracking script does not use cookies and does not collect personal data from your website visitors. We process analytics data as described in our Privacy Policy. You are responsible for complying with applicable data protection laws in your jurisdiction.

7. Intellectual Property

The Service, including its code, design, and documentation, is owned by PerchLens. Your analytics data belongs to you. We do not sell or share your data with third parties.

8. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be deleted within 30 days.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Age Requirements

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

11. Indemnification

You agree to indemnify and hold harmless PerchLens and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
